Se declaró la nulidad de las sentencias proferidas por el Tribunal y por el Consejo de Estado sobre el caso de la referencia, toda vez que se omitió la notificación de una tercera persona interesada en el proceso.
En tal sentido, la Corte ordenó al mencionado Tribunal reanudar el proceso para notificar a las partes involucradas.
Una vez surtida la primera y segunda instancia, el expediente regresará a esta Corporación para su eventual revisión.
Se suspendieron los términos hasta que se surtan los trámites previstos.

- Primero. Declarase la NULIDAD de las sentencias proferidas por el Tribunal Administrativo del Magdalena el 5 de mayo de 1997, y por el Consejo de Estado, Seccion 3a, el 5 de junio del mismo ano.
- Segundo. ORDENASE al Tribunal reanudar el proceso, notificando, ademas de la parte demandada, a la doctora JUANA AIXA VILLACOB DE BLANQUICET, Juez Segunda Penal Municipal de Cienaga (Magdalena).
- Tercero. El Tribunal dispondra tambien la notificacion de esta providencia al demandante, doctor VICENTE RAFAEL LAFAURIE CORREA.
- Cuarto. Una vez surtida la primera instancia y, en su caso, la segunda, regrese el asunto al Despacho del Magistrado Sustanciador de la Revision, para posterior examen de la Sala Quinta de Revision.
- Se suspenden los terminos en el presente proceso hasta tanto se surtan los tramites aqui previstos.
